Group Travel / Tour Terms & Conditions & Liability Acknowledgment
Reserving or participating in any travel services offered by Aggieland Scuba LLC (“Aggieland Scuba,” “we,” “us,” or “our”) constitutes a contractual agreement between the participant (“Participant,” “you,” or “your”) and Aggieland Scuba LLC.
By making a reservation or participating in an Aggieland Scuba group trip, you acknowledge that you have read, understand, and agree to be legally bound by these Travel/Tour Terms & Conditions, including all required waivers, assumption-of-risk agreements, and health and safety requirements.
You must be at least eighteen (18) years of age to make a reservation. The person making the reservation represents that all members of their party have reviewed and accepted these Terms.
Your booking is not confirmed until payment has been received and a confirmation invoice has been issued by Aggieland Scuba.
All trip deposits are non-refundable.
Due to the ever-changing nature of travel, participants are strongly encouraged to purchase travel insurance.
Participation
Aggieland Scuba reserves the right to decline, accept, or remove any participant from a trip at its sole discretion if the participant’s behavior is:
• Disruptive
• Unsafe
• Illegal
• Interfering with the enjoyment or safety of others
If a participant is removed from a trip for these reasons, no refund will be issued and the participant will be responsible for any additional expenses incurred.
Aggieland Scuba reserves the right to cancel any trip due to:
• Insufficient participation
• Safety concerns
• Environmental conditions
• Supplier cancellations
• Circumstances beyond our control
Assumption of Risk
Scuba diving, snorkeling, boating, and international travel involve inherent risks, including but not limited to:
• Decompression sickness
• Barotrauma
• Drowning
• Marine life injuries
• Equipment malfunction
• Boat or transportation accidents
• Weather and sea conditions
• Remote locations with limited access to medical care
By participating in an Aggieland Scuba trip, you voluntarily assume all risks associated with scuba diving and adventure travel, whether known or unknown.
Participants acknowledge that Aggieland Scuba LLC does not control and cannot guarantee the safety practices of third-party dive operators, boats, transportation providers, or accommodations, though we prioritize reputable vendors and operators.
Responsibility
Airlines, hotels, dive resorts, dive boats, transportation companies, and activity providers used during Aggieland Scuba trips are independent contractors.
They are not employees, agents, or representatives of Aggieland Scuba LLC.
Aggieland Scuba is not liable for:
• Personal injury
• Death
• Property loss
• Trip delays
• Schedule changes
• Supplier service failures
All services are subject to the terms and conditions of the individual service providers.
Pricing
Trip prices are quoted per person based on double occupancy, unless otherwise specified.
Pricing includes trip coordination, planning, and administrative costs and is based on:
• Current exchange rates
• Taxes and tariffs
• Supplier pricing
Aggieland Scuba reserves the right to adjust trip pricing due to:
• Currency fluctuations
• Government taxes or fees
• Supplier price increases
Aggieland Scuba does not provide itemized breakdowns of trip costs.
Reservations and Payments
A deposit is required to reserve your space on a trip.
Deposits are non-refundable. No exceptions.
Deposit amounts are listed on the trip webpage or promotional materials.
Final payment is typically due sixty (60) days prior to departure, unless otherwise stated.
Reservations made within 60 days of departure require full payment at booking.
Failure to make payment by the deadline may result in cancellation of the reservation without refund of the deposit.
Cancellation by Participant
All cancellations must be submitted in writing.
Cancellation penalties:
91+ days before departure
50% of deposit retained (unless your spot is filled)
90–61 days before departure
20% of total trip price retained
60 days or less before departure
100% of trip price retained
Airline penalties and airfare cancellations are the traveler’s responsibility.
Travel Insurance (Strongly Recommended)
Aggieland Scuba strongly recommends comprehensive travel insurance covering:
• Trip cancellation
• Medical emergencies
• Travel delays
• Lost baggage
• Emergency evacuation
If travel insurance is declined, participants assume full financial responsibility for any losses.
Dive Accident Insurance (Required)
All participants on Aggieland Scuba dive trips must carry active dive accident insurance.
Standard medical insurance policies often do not cover diving injuries or hyperbaric treatment.
Aggieland Scuba strongly recommends coverage from Divers Alert Network (DAN), which provides:
• Dive accident coverage
• Hyperbaric chamber treatment
• Medical evacuation services
Failure to maintain dive accident insurance may result in denial of participation in diving activities.
Passports and Travel Documents
Participants are responsible for ensuring they possess all required travel documents including:
• Passports
• Visas
• Vaccination documentation (if required)
For U.S. travelers, passports should generally be valid at least six (6) months beyond the return date.
Aggieland Scuba is not responsible for denied boarding or entry due to missing or invalid documentation.
Items Not Included in Trip Price
Unless specifically stated, the following are not included:
• Airfare
• Passport or visa fees
• Airport taxes
• Excess baggage fees
• Gratuities
• Optional excursions
• Meals not listed in itinerary
• Personal expenses
• Medical expenses
• Trip interruption costs
Baggage and Personal Property
Aggieland Scuba assumes no liability for lost, stolen, or damaged baggage or personal property.
Travelers should carry valuables in their carry-on luggage and ensure insurance coverage.
Photography and Media Release
Participants acknowledge that photos or videos may be taken during trips or activities.
By participating, you grant Aggieland Scuba permission to use your image, voice, and likeness in marketing, advertising, social media, or promotional materials without compensation.
Liability Waiver Requirement
All participants must complete and sign:
• Aggieland Scuba Liability Release
• Medical Statement
• Third-party operator waivers
Failure to complete required documents may result in denial of participation without refund.
Governing Law
These Terms shall be governed by the laws of the State of Texas.
Any legal dispute arising from participation in an Aggieland Scuba trip shall be resolved exclusively in the courts of the State of Texas.
